3.7. The End Consumer must provide Liderança Colorida Lda with an email or postal address, or data relating to another form of contact, that are correct and complete and accepts that Liderança Colorida, Lda may contact him/her using this data, if it deems it appropriate. The provided contact information will only be used for communication regarding orders, support, or updates about the user’s purchases.

4.1. The Firebond.store online store is intended for private and professional use, and therefore the reproduction, transfer, distribution or storage of the contents of the Firebond.store online store, without prior written authorization, is prohibited for any purpose other than strictly personal use.

5. COMMERCIAL POLICY

5.1. If the information presented does not correspond to the characteristics of the product, the Customer has the right to terminate the purchase and sale contract under the applicable legal terms.

5.2. The photographs presented on the website are merely illustrative. Therefore, the photograph may not correspond to the actual size of the product. Therefore, we recommend that you carefully consult the product details for more information about the respective characteristics of the items you wish to purchase.

5.3. Product prices and specifications are subject to change without prior notice. Despite our utmost care in keeping all information up to date, some products may have an incorrect price, so we will check the prices whenever we process orders. If the price of the product is lower than the advertised price, we will refund the difference. If the price is higher, we will inform the End Consumer by email and await their decision to accept the new proposal or cancel the order. In case of a pricing error, users will be notified via email before processing the order, with the option to proceed with the corrected price or cancel the order.

5.4. Validation of the purchase request or order assumes that the Buyer is aware of and accepts the General Terms and Conditions of Sale of the Firebond.store online store.

5.5. All data recorded by Firebond constitutes proof of the set of transactions carried out between the Seller and the end Consumer, and it is Firebond’s responsibility to archive the electronic document in which the contract is formalized, and is obliged to keep it accessible.

6. OBLIGATIONS OF CUSTOMERS AND USERS

6.3. Firebond is exempt from any liability for any delay or impossibility of processing the order due to an error or insufficiency of the data communicated by the End Consumer, particularly at the time of delivery.

7. PLACING AN ONLINE ORDER

7.1. To place an order in the Firebond.store online store, the User must have a valid and frequently used email account and register as a customer in the Firebond.store online store by filling out the form available online. Once registered, simply add all the products that the End Consumer wishes to purchase to the shopping cart, following all the purchase steps so that the purchase is completed successfully.

8. AVAILABILITY OF PRODUCTS AND ORDER CONFIRMATION/CANCELLATION

8.1. Firebond only processes an order placed by a customer after confirmation of payment, and therefore cannot guarantee the availability of the items until the beginning of said processing.

8.2. In the order confirmation, you will find the estimated date for dispatch of the products, after confirmation of payment. Naturally, the estimated time for dispatch may vary depending on the carrier and the destination of your order.

8.3. Firebond only dispatches orders on working days. Therefore, weekends and public holidays are not taken into account when estimating the delivery time of orders. Any delay in dispatching items, compared to the estimated dates presented, does not confer the right to compensation.

8.4. Fulfillment of all orders placed on the website is subject to the availability of the products. Firebond attempts to ensure that all items offered for sale on the website are in stock. However, Firebond reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer in stock. In the event of product unavailability and/or stock shortage, Firebond will immediately inform the Final Consumer of the partial or total cancellation of their order, and the buyer will be entitled to a refund of the amount paid or to choose another product. In the event of cancellation due to unavailability, the user will be informed via email and given the choice of receiving a full refund or selecting an alternative product.

9. ORDER CONFIRMATION OR CANCELLATION

9.1. Firebond may not validate an order that does not have sufficient guarantee of payment, when the order is incomplete or incorrect, or when the products ordered are no longer available. In any of the above cases, Firebond will inform the End Consumer by email that the sales contract has not been concluded and that Firebond has not proceeded with the sale, specifying the reasons for this.

9.2. If the products ordered from the Firebond.store online store are no longer available at the time of your last access to the website, despite having received confirmation of the order, or when Firebond receives your order, the Seller will immediately inform the User of their unavailability, in any event within 30 days of receipt of the order.

9.3. If an order has been placed and payment has been made for products that have since become unavailable, Firebond will refund the money paid for the unavailable items.

9.4. Firebond reserves the right to refuse any order, regardless of the reason and is exempt from liability for any damages or costs, and also reserves the right to cancel any purchase even if it has already been accepted or confirmed by Firebond, in particular in the following situations:
– The information contained in the invoice is not correct or verifiable;
– The order is flagged by the website’s Security Systems as an incorrect, irregular order, or an order susceptible to fraud;
– When the transfer of payment for the order has not been received within a period of 3 working days following the acceptance of the order;
– When it is not possible to deliver the order to the address provided by the User;
– If it considers that the Buyer did not have the capacity to perform that act; – If it is found that there was an error in the presentation of the price of the product(s);
– If it is assumed that the order comes from a reseller.

10. PAYMENT CONDITIONS AND SECURITY GUARANTEES

10.1. The available payment methods will be displayed in the Firebond.store online store. If you are unable to pay using the methods presented, you should contact us by email (info@firebond.store) so that we can analyze the possibility of offering another payment method.

10.2. You can pay for your products using your usual credit and debit cards, or using your personal Paypal account. You can also pay for your order using Multibanco, where you will be provided with all the necessary instructions for this payment method (entity/reference/total amount), or you can make a bank transfer, where you will be provided with the Firebond IBAN.

10.3. For payments made using credit or debit cards, all details (such as card number, expiry date or security code) will be sent via the Encrypted Protocol to the company that provides remote electronic payment services, Stripe, without third parties having access to the information transmitted. This information will not be used by Firebond, except to carry out the operations necessary for the purchase or refund, in the event of a return in accordance with the exercise of the right of return, or to report cases of fraud to the police.

10.4. If the End Consumer chooses to pay by Multibanco, we will only start processing the order after we have received the payment. Therefore, in this payment method, we advise you to go to the Multibanco ATM as soon as possible so that you receive your order as soon as possible. Once 3 calendar days have passed since the order was placed, and if we have not received any payment, the order will be cancelled.

10.5. If the End Consumer chooses to pay by bank transfer, proof of payment must be sent by email (info@firebond.store), which must include the order reference. We will only start processing the order after the amount has been received in our account.

10.6. We urge you not to attempt to make payment by any other means not specified in the Firebond.store online store. If you attempt to do so, Firebond cannot be held liable for the loss of payment or any other damages that may arise.

11. SECURITY OF THE FIREBOND.STORE ONLINE STORE AND ALL TRANSACTIONS.

11.1. The Firebond.store online store uses the latest and most robust security technologies available for encryption platforms. All payment information you provide will be encrypted from the initial moment of your transaction until the moment the order is processed, and will not be stored on any public server.

11.2. Although we use highly advanced encryption software, any payment transmitted over the Internet or via email runs some risks, particularly when the User does not take the necessary precautions and does not assume the appropriate responsible conduct.

11.3. Firebond shall not be liable for any damage suffered as a result of the use of electronic means of communication, in particular damage resulting from failures or delays in the delivery of electronic communications, interceptions or manipulations of electronic communications by third parties or by computer programs used for communications or transmission of viruses.

12. PRICES

12.1. The prices of products displayed in the Firebond.store online store include/include Value Added Tax (VAT).

12.2. The total price specified in the final menu includes taxes and shipping costs. Prices are quoted at the time of order confirmation, which you can print or download for future use. Please transfer only the exact amount specified in the order confirmation and make individual transfers per order.

12.3. Shipping fees are calculated per order, and the exact price of the shipping fee will depend on the country where your order will be delivered.

12.4. All prices are listed in Euros and any change in the country of delivery of the order may affect the prices, due to shipping costs.

13. QUALITY AND WARRANTY

13.1. Firebond will only sell high-quality items in the Firebond.store online store and will never sell second-hand products or products of inferior quality to existing market standards.

13.2. The products offered for sale in the Firebond.store online store may not correspond exactly with respect to the displayed image and colors, especially due to the internet browser and monitor used.

14. SHIPPING OF PRODUCTS AND DELIVERIES

14.1. Products ordered in the Firebond.store online store will be shipped and delivered on working days, from Monday to Friday.

14.2. We can only guarantee the correct delivery of an order if the shipping address for the products is correctly indicated by the User, and if this address is located in a home or office located in mainland Portugal.

14.3. Shipping rates are calculated per order, and the exact price of the shipping rate will depend on the quantity of products and the country to which your order will be delivered.

15. ORDER DELIVERY TIMES

15.1. Once your order has been registered, payment has been confirmed and all items in your order are available, Liderança Colorida, Lda undertakes to ship the product within the following delivery times:
– In mainland Portugal and Spain, between 1 and 5 working days.

– Madeira and the Azores, between 3 and 20 working days.

15.2. Liderança Colorida, Lda will not be responsible for the non-fulfillment, or delay in fulfilling, any shipping obligation that is caused by an event of force majeure, that is, an event, act or omission, beyond its reasonable control. In case of delays exceeding the estimated delivery time, users have the right to contact customer support to inquire about the status of their shipment or request further assistance.

16. PRODUCT EXCHANGES AND RETURNS

16.1. After receiving the order, the Buyer has a period of 15 days to return or exchange his/her item(s) if he/she finds that they have defects or other non-conformities in relation to the products ordered. The product must not be used.

16.2. The costs of an initial return or exchange will be borne by Firebond, provided that it is due to product defects. In subsequent returns and exchanges, the shipping costs will be borne by the customer.

16.3. The Buyer’s order exchange or return must be carried out in the following manner:
– Place the item in the original box. Close the box and seal it with tape. If the box has any labels, stickers or other materials from previous shipments, remove them. – The product will be collected within a maximum of 5 working days after you have made the return request. You will be contacted by customer support services to schedule the collection of the product. If you are not at the address indicated at the time of collection, a new collection will be scheduled on a date/time to be agreed between the customer and the transport company.
– Collections are not carried out on holidays and weekends.
– After receiving the product at our warehouse, the Quality Department will check whether the item complies with our requirements for Exchange or Return. If so, the exchange will be confirmed or a refund will be made.
– To reimburse the amount paid, Firebond offers the User two options: issuing a voucher for the value of the returned products, which can be redeemed only in the online store Firebond.store within a maximum period of 6 months from the date of issue; or the refund itself, using the same payment method used for the purchase.

16.4. Firebond will arrange collection with the carrier within 5 working days after receiving confirmation of the exchange/return. Collection will be made from Monday to Friday, and it is not possible to schedule a specific time.

16.5. After receiving all or part of the products ordered at our facilities, we will process them within two to five working days. If the return is confirmed, the amount will be refunded to you using the same payment method. Refunds will only be made to the account/card that originated the purchase. In the case of an exchange due to a product defect, then, after checking the availability of that product, it will be sent to the address you indicate during the exchange process. Refunds will be processed within 14 business days after the returned product is received and inspected.

17. CANCELLATION OF ORDERS

17.1 Before shipping, the Buyer may cancel the order of products. If the User places an order and wishes to cancel it, he/she must first contact our Customer Support Service to ask about the status of the order, and if it has not yet been sent, he/she may then request the cancellation of his/her order.

18. CONDITIONS APPLICABLE TO PROMOTIONAL CODES (DISCOUNTS)

18.1. When used in accordance with the established rules, a promotional code entitles the user to benefit from a promotion/discount on the purchase of a specific product or set of products, during the period indicated/associated with the promotional code/promotional campaign.

18.2. Promotional codes are personal and non-transferable and can only be used for online purchases made on the website. The sale, exchange or donation of a promotional code is not permitted. The customer holding the promotional code may not upload or make available a promotional code on any website or other public form of offer, donation, sale or exchange. The use of promotional codes for commercial purposes is not permitted.

18.3. The use of a promotional code is subject to one use per product and per order only. Promotional codes cannot be combined with any other promotions or special offers.

18.4. Promotional codes cannot be exchanged for cash and will not be reissued or refunded.

18.5. Without prejudice to any other rights, Firebond reserves the right to immediately invalidate the promotional code issued if it suspects that a promotional code is being used in violation of the abovementioned conditions.

18.6. Firebond reserves the right to invalidate any promotional code in cases of misuse, fraud, or if the code is used in violation of these terms.

19. VALIDITY OF PROMOTIONS OR COMMERCIAL CAMPAIGNS

19.1. Promotional offers or commercial campaigns advertised in the Firebond.store online store are valid only for the time they are displayed on the website and in accordance with the established conditions, unless otherwise stated on the website.

19.2. In the event of the return or exchange of items purchased as part of commercial campaigns or promotions, you will only be credited or given the amount that you actually spent on the purchase of the item you wish to return or exchange.

19.3. The conditions for returning orders placed during campaign/promotion periods may be changed and will be mentioned in a menu created specifically for this purpose.

20. LIABILITY

20.1. Firebond shall only be liable for damages suffered by the Buyer if such damages result from breaches attributable to Firebond’s contractual obligations towards the End Consumer, or if the liability results from applicable legal law.

20.2. If the Buyer has suffered damages related to the activity of the website, Firebond’s liability shall be limited to damages to the products of the Firebond.store online store and to reasonable and verifiable costs incurred by the Buyer due to Firebond’s breach of these General Terms and Conditions of Sale.

20.3. Firebond shall not be liable for damages suffered by third parties resulting from the use of any of our products. Firebond shall not be liable for any damages suffered by the Buyer as a result of improper use of our products.

20.4. Firebond shall not be liable for any damages resulting from incorrect information on the website.

20.5. All products sold in the Firebond.store online store comply with Portuguese and EU legislation.

20.6. Firebond shall not be liable in the event of any violation of the legislation of the country where the order is delivered. It is the responsibility of the end Consumer to check with the local authorities the conditions for importing or using the products he/she wishes to order.

20.7. Firebond shall not be liable for indirect or consequential damages arising from the use or inability to use the website or products, including lost profits or loss of data.

21. INTELLECTUAL AND INDUSTRIAL PROPERTY

21.1. All texts, comments, works, illustrations, works and images reproduced or represented in the Firebond.store online store are strictly reserved under copyright and intellectual property rights, for the entire world.

21.2. Accordingly and in accordance with the Intellectual Property Code, the use of information for private purposes is only authorized, subject to any contrary provisions, including more restrictive provisions contained in said code.

22. APPLICABLE LAW

22.1. These General Terms and Conditions of Sale and all disputes arising in connection with these general terms and conditions, including their validity, the use of the Firebond.store online store or any purchase therein shall be governed by Portuguese law.

22.2. In the event of a dispute regarding the interpretation or execution of these General Terms and Conditions of Sale, Firebond and the Buyer undertake to endeavour to obtain an amicable solution, which is fair and appropriate, within a maximum period of 60 (sixty) days from receipt of the communication addressed for this purpose by either party involved.

22.3. In the event of a consumer dispute, the consumer may use the European online dispute resolution platform available at https://webgate.ec.europa.eu/odr. 22.4. In the absence of an amicable solution, as provided for in the previous paragraph, and in the event of non-compliance with these General Terms and Conditions of Sale, both parties establish the Court of Vila Nova de Gaia as the competent court, expressly waiving any other.

23. AMENDMENT TO THE GENERAL TERMS AND CONDITIONS OF SALE OF THE FIREBOND.STORE ONLINE STORE

Firebond has the right to amend these General Terms and Conditions of Sale at any time. The Buyer is subject to the principles and terms in force on the date of his/her order, unless the law or competent authority imposes any amendment to them.
